If you are pulled over for a DWI, you must bear in mind that from the moment that the officer pulls you over, you are now providing evidence—potentially against yourself. Always keep in mind that, while you want to be cooperative and keep yourself safe, everything you say and do will be used against you in a later prosecution. When the officer interrogates you, you are not obligated to give any evidence that you think would be against your best interests. You do have the right to remain silent.

Allow the officer the opportunity to assess the situation, and he or she may not charge you if there is no reason for a charge. Be honest and polite, but always remember that you should not say anything that you are not obligated to say. You cannot take a potentially incriminating statement once it is said.
