Bringing Forward a Claim Under the Child Victims Act
According to the new Child Victims Act that will be enacted on August 14, 2019, you will have one year from that date to bring a claim for any past abuse that you have endured. This small window of time is to reopen the possibility of bringing claims for those whose statute of limitations may have already expired years ago. Even if you had previously made a claim in the past which was denied, you can now reopen the case under this new law. However, you will only have until August 14, 2020, to file your claim, so it is important to act fast and contact our Hamburg sexual abuse attorneys right away.
There is also a new statute of limitations for victims of childhood sex abuse from a pastor, coach, or teacher. In years past, you would only have until the age of 23 to bring a claim forward. That is now extended to the age of 25 to bring a misdemeanor charge, 28 if you want to bring a criminal charge against your abuser, or the age of 55 if you want to pursue a civil claim. The Child Victims Act applies to any victim of sexual abuse who was under 18 years old when the incident occurred.
Protecting Victims of Boy Scout Abuse
For decades, the Boys Scouts of America has been an organization helping educate children with life lessons and a sense of discipline. But for as long as the organization has been in existence, there has been a history of sexual abuse and assault among its leaders that is just recently coming to light. Since the 1920s, the Boy Scouts have kept a long list of files that detail the horrific misconduct perpetrated by Scout leaders upon innocent children. These Ineligible Volunteer Files—otherwise known as the Perversion Files—have been released by the courts and are available to the public. However, just because an abuser may not be on the list, that does not mean the abuse didn’t occur.
If you or your child has been sexually abused as a member of the Boy Scouts, it is important that you speak to our Hamburg sex abuse attorneys right away. We offer a free confidential consultation, and we make sure that everything said to us is held in the strictest of confidence. We are here to support you and make sure that abusers and the organizations they belong to are held accountable and brought to justice.
Helping Clergy Abuse Victims Recover
Over the past few years, more and more claims of clergy abuse have been brought forward against the Buffalo Diocese. This has led to the uncovering of a long history of sexual misconduct within the Catholic Church among its priests and clergymen. Putting your faith in a religious leader only to have that trust abused is the ultimate betrayal, and the Hamburg sexual abuse attorneys at Chiacchia & Fleming, L.L.P, will not stand for it.
It might seem wrong to bring a claim against a church, but if your human rights have been violated by a clergy member, this is not only morally just, but it is the right thing to do. We understand that recovering reparations from the diocese will be a hard battle, but we want to fight it on your behalf. Our Hamburg sexual abuse attorneys are trial ready and have a proven track record of protecting the rights of sexual abuse victims. If you or a loved one has been sexually abused by a priest at any point in your life, please contact us right away so as not to miss the statute of limitations. We will make sure your abusers, and anyone involved with covering it up or turning a blind eye, face the consequences of their actions.
