Every once in awhile, we meet someone who has a commercial driver’s license and gets a DWI. Those are sad days for me because, unfortunately, even though you may be entitled to get a conditional license, they will not give you conditional driving privileges for your CDL, so if you drive a CDL vehicle for a living, you are out of luck.
You may plead guilty to driving while ability impaired, which only carries a 90-day suspension of your license; however, the DMV will extend your CDL suspension for an entire year. If you hold a CDL, you can’t even think about drinking and driving because it could eliminate your ability to earn a living. I’ve represented a number of truck drivers who own their own rigs. If you know anything about that business, you know that if you’re not on the road making money, you can’t make your truck payment. It’s a very bad day for those people when they get a DWI. You really have to be careful about that.
